Section 165.17 prohibits a person from the unlawful use of the display of a credit card to purchase with the knowledge that the card is canceled or revoked. Stealing a credit card is a Class E Felony that can result in prosecution for Criminal Possession of Stolen Credit Cards and can result in up to four years of prison time. If you sign for a purchase using the name of the actual cardholder, an additional charge of forgery may be added. Identity Theft in the First Degree, Credit Card Grand Larceny & Theft, and Grand Larceny from the Person are also potential additional charges for credit card fraud in New York.

Forged Credit Cards:
Possessing a credit card that has been forged, altered, or is a fraudulent copy is considered a Criminal Possession of a Forged Instrument in the Second Degree and is prohibited by New York Penal Law Section 170.25. This is considered a Class D felony which can have penalties of up to seven years in prison.
